Product availability
Please note that, exceptionally, we have no obligation to deliver the order to you if our suppliers do not deliver the stock correctly or on time, even if we have acted in accordance with our usual ordering practice. In order for us to apply this exception and therefore not to assume any responsibility, we cannot be responsible for the products not being available and we must have notified you of the situation without undue delay. In addition, we cannot have assumed a purchase risk in relation to the product ordered.

Consumer goods guarantee
EL IMPERIO DEL HOBBY, S.L.U. will deliver to the user products that are in accordance with the contract, that is, conform to the description made and possess the qualities of the product that have been presented to the user and will respond to him for any lack of conformity that exists from the moment of delivery of the product.
In accordance with the provisions of article 123 of Royal Legislative Decree 1/2007 of November 16, which approves the revised text of the General Law for the Defense of Consumers and Users, EL IMPERIO DEL HOBBY, S.L.U. will be liable for the lack of conformity of the products that manifest themselves within two years of delivery.

Failure to comply with this deadline does not imply the loss of the guarantee, but the user will be responsible for damages caused by the delay in communication.
In case of defective product, EL IMPERIO DEL HOBBY, S.L.U. will proceed, as appropriate, to the repair, replacement, reduction of the price or termination of the contract, procedures that will be free of charge for the consumer and user.
As a customer, you are considered a consumer in accordance with Royal Legislative Decree 1/2007, of 16 November, which approves the revised text of the General Law for the Defence of Consumers and Users and other complementary laws (hereinafter, "TRLGDCU").
Consequently, you have the right of withdrawal that consists in you being able to cancel the contract concluded without having to justify your decision during the fourteen (14) calendar days from the receipt of the acquired good or from the conclusion of the contract if it is a provision of services.
You must express your intention to withdraw within the indicated period and proceed to the return of the product, refunding the price paid.

Price of products and payment
All prices on our website are published with "VAT Included" being this 21% for all products.

Shipping conditions
EL IMPERIO DEL HOBBY, S.L.U. only sends its products to: Spain, United Kingdom, USA. USA, Canada, Australia, China, Japan, Russia and the countries of the European Economic Area (EEA) that you can consult here:
The purchase is subject to the payment of shipping costs, at the expense of the buyer. The shipping costs will depend on the destination, the weight and the total amount of the order, the expenses will be detailed throughout the purchase process and you can check how much the shipping costs amount to before completing the purchase.
EL IMPERIO DEL HOBBY, S.L.U. will not be responsible for the delay in the delivery of orders for reasons not attributable to it, as well as for fortuitous cases or force majeure.
The delivery will be made through the transport company selected by the user during the purchase process.
Package shipments, depending on their size, weight and destination, can currently be made through the following transport agencies: GLS for domestic shipments and to the EEA and Post office for other destinations.
Delivery times
The delivery through the transport company GLS will be made between 24 and 72 hours after the confirmation of payment, for products with availability and without customization, in Spain (peninsula). For the rest of the places or for products without availability, personalized or on request, you can consult our page"Delivery of your order"or request information through the contact form.
Due to unforeseen circumstances, delays in delivery may occur. If for any reason we could not meet the delivery date, we will inform you of this circumstance and we will give you the option to continue with the purchase by establishing a new delivery date or cancel the order with the full refund of the price paid. Please note in any case that we do not make deliveries on Saturdays, Sundays or holidays. For the purposes of these conditions, it will be understood that the "delivery" has taken place or that the product(s) have been "delivered" at the time of signing the receipt of the same at the agreed delivery address.
In sales season, during special promotions, Black Friday and on dates of high product turnover such as Christmas, delivery dates can suffer a delay of between 48 and 72 hours depending on the availability of the products.
Incidents in delivery
Record any anomaly of the product on the delivery note at the time of delivery. If it has not been possible to record the fact on the delivery note, please contact us by email on the same day of delivery, or in any case, within 24 hours of delivery.
Keep in mind the following regulations regarding transport: The delivery note is the proof of the condition of the goods. The consignee will be obliged to record the delivery if the shipment is damaged and if the shipment is complete. Claims will not be accepted if it does not appear on the delivery notes or if you make the claim after 24 hours after the delivery of this. You should not sign a delivery note before receipt of the goods. If the delivery driver says otherwise, do not take the goods or record this fact on the delivery note.
In case of replacement of a defective product: EL IMPERIO DEL HOBBY, S.L.U. undertakes to deliver another product in perfect condition and to collect the defective one. In the event that this change cannot be made, you will be paid the full amount advanced.
From Monday to Friday from 09:00 to 14:00 hours and from 16:00 to 18:00 hours, we will attend all claims and queries received about the delivery of your order at the email address: info@elimperiodelhobby.com and through the messages left on the form for that purpose in your order.
Telephone complaints will also be answered from Monday to Friday from 09:00 to 14:00 and from 16:00 to 18:00.
Transfer of risk and ownership
The risks of the Products will be borne by you from the moment of their delivery. You will acquire ownership of the products when we receive full payment of all amounts due in connection with them, including shipping costs, or at the time of delivery, if it takes place at a later time.

Exchange / returns policy

Return conditions
IMPORTANT: When it is a personalized product or on request (ordered exclusively for you and under your responsibility), it can not be returned, unless of course, we have made an error when preparing your order or that the product has a defect.
Consequences of withdrawal
In case of withdrawal on your part, we will proceed to reimburse you for the payments you have made, including shipping costs in the event that the return is for reasons attributable to EL IMPERIO DEL HOBBY, S.L.U. (defective product or not coinciding with the purchased reference), with the exception of the additional costs resulting from the choice by you of a different shipping method to the least expensive ordinary shipping method that we offer, without any undue delay and, in any case, within 14 days from the date on which we have been informed of your decision to withdraw from this contract.
In the event that the return is for reasons not attributable to EL IMPERIO DEL HOBBY, S.L.U. such as changes in color or other characteristics, which are due to a change of opinion or error on your part when making the purchase you must be the one who is responsible for returning or delivering directly the products in perfect condition without any undue delay and, in any case, at the latest within 14 calendar days after receipt of the products. In these cases EL IMPERIO DEL HOBBY, S.L.U. will refund all payments received, except shipping costs. Likewise, you must be the one who assumes the direct cost of the return of the products.
The refund will be made using the same means of payment that you used for the initial transaction, unless it has been expressly agreed otherwise. We will not charge you any fees as a result of the refund. We may withhold the refund until we have received the products, or until you have provided proof of the return of the products, depending on which condition is met first.
The products must be returned or delivered no later than 14 days from the date on which you inform us of your decision to terminate the contract.
EL IMPERIO DEL HOBBY, S.L.U. will proceed to make the refund within 14 calendar days from the date on which we are informed of the decision to return the purchase and will do so using the same means of payment used by the customer for the initial transaction. Exceptions to the right of withdrawal
Some products and services are excluded from the legally provided right of withdrawal, unless otherwise agreed.
According to article 102 of the Consolidated Text of the General Law for the Defense of Consumers and Users, hereinafter TRLGDCU, the exceptions to the right of withdrawal are as follows:
- Contracts for the supply of goods the price of which is subject to fluctuations in market coefficients which the employer cannot control.
- Contracts for the supply of products made according to the specifications of the consumer and user or clearly personalized, or that, by their nature, cannot be returned or may deteriorate or expire quickly.
- Contracts for the supply of sound or video recordings, discs and computer programs that have been unsealed by the consumer and user, as well as computer files, supplied electronically, capable of being downloaded or reproduced immediately for permanent use.
- Contracts for the supply of daily newspapers, periodicals and magazines.
- Contracts for the provision of services, whose execution has begun, with the agreement of the consumer and user, before the end of the period of seven working days.
- Contracts for betting and lottery services.
IMPORTANT: When it is a personalized product or on request, it can not be returned, unless of course, we have made an error when preparing your order or that the product has a defect.
In the case of contracting services, their execution will begin at the same time of confirming the payment of these, giving your express consent when making the payment, thus waiving any right of withdrawal.
Any virtual product, offered under a download system and/or supplied electronically of any kind, as well as any software product, is excluded from the right of withdrawal.
Liability and disclaimer
Our liability in relation to any product purchased on our website shall be strictly limited to the purchase price of such product. Nothing in these General Terms and Conditions of Sale excludes or limits in any way our liability.
Without prejudice to the provisions of the previous paragraph and to the extent permitted by law, and unless otherwise provided in these conditions, we will not accept any liability for indirect damages that occur as a side effect of the losses or main damages, that occur in any way, and whether caused by tort (including negligence), even if they could have been foreseen, including without limitation the following:
- Loss of revenue or sales.
- Loss of business.
- Loss of profits or loss of contracts.
- Loss of expected savings.
- Data loss.
- Loss of management time or office hours.
- Strikes, lockouts or other protest measures.
- Civil commotion, revolt, invasion, terrorist attack or threat, war (whether declared or not) or threat or preparations for war.
- Fire, explosion, storm, flood, earthquake, subsidence, epidemic or any other natural disaster.
- Impossibility of using trains, boats, planes, motor transport or other means of transport, public or private.
- Impossibility of using public or private telecommunications systems.
- Acts, decrees, legislation, regulations or restrictions of other governments.
- Strike, failure or accident of maritime or fluvial transport, postal or any other type of transport.

All product descriptions, information and materials contained on this website are provided "as is" and without express, implied or otherwise implied warranties. Events beyond our control

- Strike, failure or accident of maritime or fluvial transport, postal or any other type of transport.
- Strikes, lockouts or other protest measures.
- Civil commotion, revolt, invasion, terrorist attack or threat, war (declared or not) or threat or preparations for war.
- Fire, explosion, storm, flood, earthquake, subsidence, epidemic, pandemic or any other natural disaster.
- Impossibility of using trains, boats, planes, motor transport or other means of transport, public or private.
- Impossibility of using public or private telecommunications systems.
It will be understood that our obligation of performance under any Contract will be suspended during the period in which the Cause of Force Majeure continues, and we will have an extension in the term to fulfill our obligation for the duration of such period. We will use all reasonable means to terminate the Cause of Force Majeure or to find a solution by which we can fulfill our obligations under the Contract despite the Cause of Force Majeure.
Resignation
If during the term of a contract, we stop insisting on strict compliance with any of the obligations assumed under it or any of these conditions, or if we stop exercising any of the rights or remedies that we were entitled to exercise or file under said contract or these conditions, such fact shall not constitute a waiver of such rights or remedies nor shall it relieve you of such obligations. Our waivers of enforcement shall not constitute a waiver by us of further performance. No waiver by us of any of these conditions will take effect, unless it is expressly stipulated that it is a waiver and communicated to you in writing in accordance with the provisions of the notifications section above.
Nullity and ineffectiveness of the clauses
If any clause included in these Conditions is declared totally or partially, null or ineffective, such nullity or ineffectiveness will only affect said provision, subsisting these General Conditions in everything else, having such provision not included.
Our right to modify these conditions
We have the right to review and modify these conditions at any time. you will be subject to the policies and conditions in force at the time you place each order, unless by law or decision of government agencies we must make changes to said policies, conditions or our Privacy Policy,in which case, the possible changes will also affect the orders you have previously placed.

Applicable Law and Jurisdiction
